Mormon Teen Terms and ConditionsUpdated February 20071. Introduction1.1 You must read and accept this legal agreement before accessing or using any of the services provided by Mormon Teen through http://www.mormonteen.com (“MTâ€). By accepting the terms of this agreement (“agreementâ€), and completing the registration process, you are representing that you are between 14 years and 19 years of age (or you are a qualified adult, see below), and that you can and will be legally bound to it. No person may join or participate on MT where so doing would be prohibited by applicable law or regulation. 1.2 If you have not reached the age of 18, then your parent or guardian must read and accept the terms of this agreement on your behallf, before you register. 1.3 MT cannot verify the age or identity of MT members. MT urges all members to not provide telephone numbers, street addresses, last names, URLs, or email addresses to other members. 1.4 With certain limitations, persons over 19 may register with MT. These persons must be either a Parent/Guardian of a current member of MT or they must be an LDS Youth Leader holding an official LDS 'calling' to work with youth between 12 and 19 years old. Such persons ('qualified adults') must identify themselves as an adult in all communications with other members of MT. No other person over the age of 19 may register with, or use any service of, MT. 1.5 Those persons who registered with MT as teenagers, but who currently are older than 19, may continue to use MT for a reasonable period of time. However, they must identify themselves as adults to all other members of MormonTeen. 1.6 MormonTeen is neither a safe nor an unsafe place, instead it is what you make of it. Therefore you agree to never post or disclose your telephone number, street address, last name or other information that could be used to identify you. You acknowledge that other persons on MormonTeen may not be who they say they are and that they may misrepresent their age, sex, place of residence and other such information. You agree never to arrange to contact someone you met on MormonTeen without your parents consent and without your parents accompanying you to any such meeting. 2 ModificationsMT may at any time modify any relevant terms and conditions, policies or notices. You acknowledge that by visiting the website from time to time, you shall become bound to the current version of the relevant terms and conditions (the "current version") and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the website. If you object to any of the terms or conditions of this agreement, or subsequent changes to it, or if you become dissatisfied with MT in any way, your only recourse is to promptly discontinue using MT, delete your registration with MT, and notify MT of your termination. 3 Information on the WebsiteWhilst every effort is made to update the information contained on this website, neither the Website Owner nor any third party or data or content provider make any representations or warranties, whether express, implied in law or residual, as to the sequence, accuracy, completeness or reliability of information, opinions, information, and/or content contained on the website (including but not limited to that which may be provided by any third party or content providers) ("information") and shall not be bound in any manner by any information contained on the website. MT reserves the right at any time to change or discontinue without notice, any aspect or feature of this website. You rely on the information contained on this website at your own risk. Specific UseYou further agree not to use the website to send or post any message or material that is unlawful, harassing, defamatory, abusive, indecent, threatening, harmful, vulgar, obscene, sexually orientated, racially offensive, profane, pornographic or violates any applicable law and you hereby indemnify MT against any loss, liability, damage or expense of whatever nature which MT or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of MT to send or post any such message or material. MT reserves the right, but does not assume the obligation to monitor your use of MT in order to enforce this agreement. However, MT does not guarantee that its monitoring will be to your satisfaction. Upon learning of a violation, MT may, in its sole discretion, terminate your access and use of MT, require you to remedy any violation(s), and/or take any other action that MT judges appropriate to enforce its rights and pursue all legal remedies. MT reserves the right (without limitation) to terminate your access and use of MT if, in our sole discretion, you violated our ‘User Submissions’ policy (supra), or if your conduct does not meet the following guidelines: 6.1 Users shall not engage in any activity that constitutes defamation, abuse, harassment, stalking or in violation of the rights or other persons. 6.2 Users shall not list personal information of other persons without their express written permission, including but not limited to, email addresses, photographs or images, birthdays, phone numbers, addresses, etc. 6.3 Users shall not list information about themselves which is fictitious, including but not limited to all information in 6.2 supra. 6.4 Users shall not misrepresent their identity or impersonate any other person or entity 6.5 Users shall not upload images or other content which promotes illegal substances or activities, including but not limited to, drinking, smoking, substance abuse, weapons use, or gang affiliation. 6.5 Users shall not solicit information from anyone under 18 nor shall they provide material to that exploits anyone under 18 in a sexual or violent manner. 6.6 Users shall not provide instructional information about illegal activities including but not limited to illegal weapons, providing or creating computer threats, or invasions of another’s privacy. MT reserves the right to interpret and enforce these guidelines according to its own discretion. Violations of these guidelines may result in a users access being terminated without notice. 7. PrivacyYour privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used. To make this notice easy to find, we make it available on our homepage and at every point where personally identifiable information may be requested. 7.1 The Way We Use Information:We use non-identifying and aggregate information to better design our website and to share with advertisers. For that reason, we never collect or maintain information at our website from those we actually know are under 14 yrs old. 7.3 Sharing Information with Third PartiesIn the event that a registered user acts in an inappropriate way, we reserve the right to share that user's profile information with law enforcement agencies, religious leaders, parents or close relatives, psychiatrists/psychologists or other entities as we in our sole discretion deem appropriate. 8. Your Account and PasswordAfter you register at MT, your will receive an account and a password. You are solely responsible for the security and privacy of your account and password. You are also solely responsible for all activities which occur on your account. You agree to immediately notify MT of any unauthorized use of your account or of any breach of your account security known to you. 9. Copyrights, Trade Marks, Patents and Intellectual PropertyThe trade marks, names, logos and service marks (collectively "trade marks") displayed on this website are registered and unregistered trade marks of the Website Owner. Nothing contained on this website should be construed as granting any license or right to use any trade mark without the prior written permission of the Website Owner. MT expects you to respect intellectual property law and not to engage in illegal and/or unauthorized copying, distribution, modification, public display or performance of copyrighted works. MT may terminate with or without cause at any time and effective immediately, at MT’s sole discretion, and member’s rights to use MT will terminate immediately. You shall have no right and MT shall have not obligation thereafter to forward to you any unread or unsent messages. 12 Entire Agreement.These terms and conditions constitute the sole record of the agreement between you and MT in relation to your use of the website. Neither you nor MT shall be bound by any express tacit or implied representation, warranty, promise or the like not recorded herein. Unless otherwise specifically stated these terms and conditions supersede and replace all prior commitments, undertakings or representations, whether written or oral, between you and the Website Owner in respect of your use of the website. 13 Severability.All provisions of any relevant terms and conditions, policies and notices are, notwithstanding the manner in which they have been grouped together or linked grammatically, severable from each other. Any provision of any relevant terms and conditions, policies and notices, which is or becomes unenforceable in any jurisdiction, whether due to voidness, invalidity, illegality, unlawfulness or for any reason whatever, shall, in such jurisdiction only and only to the extent that it is so unenforceable, be treated as pro non scripto and the remaining provisions of any relevant terms and conditions, policies and notices shall remain in full force and effect. 14 Applicable laws.Any and all disputes, controversies, or claims arising out of or relating to these Terms and Conditions shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis in Missouri, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Boone or Jefferson County, Missouri and judgment on the arbitration award may be entered in any court having jurisdiction thereof. Either you or MT may seek any interim or preliminary relief from a court of competent jurisdiction necessary to protect the rights or property of you or MT pending the completion of arbitration.
